One of the reasons that individuals should be able to use the "Stand Your Ground" law when their life is threatened is because they are defending themselves.
People who are simply defending themselves are made to look like the aggressor and put in jail. Self-defense and Assault can easily be mistaken for one another if there are no witnesses. Self-defense is "the right to use reasonable force to protect oneself or members of the family from bodily harm, or to a lesser extent, one's property, from the attack of an aggressor, if the defender has reason to believe he/she/they is/are in danger. Self-defense is a defense to a criminal charge or to tort liability."
Those who acquire or own guns for self-protection are reacting to the perceived and real threats of modern American life. One study of those who own guns for self-protection found key explanations in feelings of vulnerability to crime and police ineffectiveness.
Is shooting, stabbing, or physical contact on a person in self defense more then once considered excessive force?
I argue that shooting, stabbing, or physical contact on a person in self defense more then once is considered excessive force in the eyes of the law, and those prosecuting any case. “Defending the Self-Defense Case by Lisa J. Steele”.(par.3). “Self-defense is all-or-nothing. In order to establish it, the client has to admit being at the crime scene, with a weapon, which he or she used to intentionally harm the aggressor. The client has to admit that he injured the aggressor. The client has to convince the jury that if a reasonable person had been standing in his shoes, the reasonable person would have done the same thing. In effect, the aggressor invited his fate by threatening or inflicting serious bodily harm, or by threatening to kill the client.”(par.3).
According to most cases the individual claiming self defense has to be placed threw scrutiny an a thorough investigation to determine there innocence. Yet it is still bias depending on whoever the prosecutor is. Depending on what the evidence shows, and what the psychological mindset was/is during the time of the act of defense, is what can determine what the outcome of a self defense case will be.
